Terms of Service
These Terms of Service ("Terms") govern your use of luxuriouscomputers.com and any purchase, trade-in, or warranty service from LuxuriousComputers (operated out of 123 Center Street, Marion, OH 43302, USA). By using the site or buying from us, you agree to these Terms. If you don't agree, don't use the site.
1. Acceptance of Terms
Your use of this site, placement of an order, submission of a trade-in, or interaction with the Rick chat constitutes acceptance of these Terms and our Privacy Policy. We may update these Terms at any time; the "Last updated" date at the top of this page is authoritative. Material changes will be posted on the homepage.
2. Description of Service
LuxuriousComputers sells refurbished Apple hardware (MacBooks, iMacs, Mac minis, Apple TV, Apple Watch, AirPods, Vision Pro, and related accessories), offers trade-in credit toward those purchases, and provides a 1-year whole-machine replacement warranty on every unit we ship. Machines are sourced from auction houses, corporate fleet refreshes, estate sales, and direct-from-owner buybacks, inspected at our facilities, and shipped from our warehouses or picked up at our Marion, Ohio flagship.
3. Eligibility + Accounts
You must be at least 18 years old (or the age of majority in your jurisdiction) and legally able to enter into a contract. If you create an account, you're responsible for keeping your credentials safe. You must give us accurate contact information so we can reach you about your order and warranty.
4. Products, Pricing, and Availability
- All products are refurbished. Cosmetic condition is as described in the listing.
- Prices are in USD and may change at any time before you place an order.
- Availability is not guaranteed. If we can't fulfill your order after payment, we'll issue a full refund within 5 business days.
- Pricing and specification errors happen. If a listing shows an incorrect price or spec, we reserve the right to cancel the order and refund you; we won't ship a machine at an obviously-wrong price.
- Ohio residents pay 7.25% sales tax, applied at checkout. Other states/countries: tax is calculated per jurisdiction.
5. Trade-In Terms
Our trade-in program works like this:
- You request a quote. Upload photos and tell us make/model/condition. We appraise and send a quote.
- You accept the quote. The quote is good for 14 days.
- You ship. We send a prepaid label; you ship your machine. Risk of loss during shipment is on the carrier, but we'll work with you on any claim.
- We inspect. If the machine matches the photos + description, we apply the full quoted credit. If it differs materially (undisclosed damage, wrong model, doesn't power on when you said it did), we'll send you an adjusted offer within 5 business days.
- If you reject our adjusted offer, you have 14 days to pay return shipping ($40) and we'll send it back. After 14 days of no response, the unit is considered abandoned and we may recycle or dispose of it at our discretion. See Returns.
- We credit. Credit is applied against your purchase. Unused credit expires 12 months from issuance.
6. One-Year Warranty
Every refurbished unit we ship comes with a 1-year whole-machine replacement warranty starting on the date of delivery. If a covered part fails on its own within the warranty period, we ship you another refurbished unit of equal or better spec within 48 hours of confirming the failure, and you ship the broken one back on our prepaid label.
What's covered
- Logic board failures
- Battery swelling or premature end-of-life (below 80% of original capacity)
- Keyboard or trackpad mechanical/electrical failure
- Internal storage (SSD) failure
- Dead or malfunctioning ports
- Speaker, microphone, or camera hardware failure
- Display failure that is not impact-related (dead backlight, dead pixels from panel defect, stuck lines)
What is NOT covered. We are a warranty, not insurance. The following are explicitly excluded:
- Drops and impact damage
- Spills and liquid ingress
- Cracks in screen, chassis, or keycaps
- Water damage of any kind, from any source
- Intentional damage
- Cosmetic wear (scratches, scuffs, dents, discoloration)
- Software/configuration issues you caused (third-party apps, OS tinkering, jailbreaks, kernel extensions)
- Modifications, unauthorized repairs, or opening the unit
- Theft, loss, or acts of nature
- Normal battery aging above the 80% floor
For accident protection, you'd want AppleCare+ purchased separately from Apple, or a third-party device-insurance policy.
How to file a warranty claim
Email rick@luxuriouscomputers.com with your order number and a description of the failure (ideally a short video). We'll triage, confirm coverage, and ship you a replacement from our nearest warehouse. No RMA wait.
7. Shipping + Risk of Loss
We ship via FedEx, UPS, and USPS from the warehouse closest to you. For outbound shipments to customers, risk of loss passes to you when the carrier accepts the package. If a package is lost or damaged in transit, we'll work with you and the carrier to file a claim; in practice, we typically ship a replacement first and recover from the carrier ourselves. For inbound trade-in shipments on our prepaid label, risk of loss remains with the carrier and you are not liable.
8. Returns + RMA
We offer a 30-day money-back window and a separate warranty-replacement flow. Full details, including restocking-fee policy and DOA terms, are at our Returns & Warranty page.
9. Payments (Stripe)
All payments are processed by Stripe, Inc. We never see your full card number. Stripe's Terms and Privacy Policy apply to the payment transaction. If your payment is disputed, reversed, or charged back, we may suspend your order and any pending warranty coverage until the matter is resolved.
10. Prohibited Use
- No reselling our warranty coverage — the warranty covers the original purchaser only.
- No abuse, scripted scraping, or denial-of-service behavior against our site or APIs.
- No impersonating other customers on trade-ins or warranty claims.
- No use of our products for unlawful purposes.
11. Intellectual Property
All site content — copy, photography, layout, code — is the property of LuxuriousComputers. You may not copy it wholesale for commercial use. "Apple," "Mac," "MacBook," "iMac," "iPad," "Apple TV," "Apple Watch," "AirPods," and "Vision Pro" are trademarks of Apple Inc.; we are not affiliated with, endorsed by, or sponsored by Apple Inc.
12. Dispute Resolution
Before filing anything, email rick@luxuriouscomputers.com — we resolve nearly everything in one email. If we can't, disputes shall be brought in the state or federal courts located in Marion County, Ohio, with small-claims matters handled in Marion County Municipal / Small Claims Court. You waive any objection to venue there.
13. Governing Law
These Terms are governed by the laws of the State of Ohio, USA, without regard to conflict-of-laws principles. The UN Convention on Contracts for the International Sale of Goods does not apply.
14. Limitation of Liability
To the fullest extent allowed by law, our total liability to you for any claim arising from these Terms, the site, a product, or a warranty claim is limited to the amount you paid us for the product at issue. We are not liable for indirect, incidental, consequential, special, or punitive damages, lost profits, lost data, or business interruption — even if we were advised of the possibility. Some jurisdictions don't allow these limits; in those places, our liability is limited to the minimum extent permitted.
15. Disclaimer of Warranties (Beyond the 1-Year Warranty)
Except for the express 1-year warranty described above, the site and all products are provided "AS IS" and "AS AVAILABLE." We disclaim all other warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the extent allowed by law.
16. Modifications
We may modify these Terms at any time. Continued use of the site after changes are posted means you accept the new Terms. If we change something material to an active warranty you already have, the prior terms still govern that warranty.
